Terms of Service

1. Agreement to Terms

By accessing or using Vozio ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Vozio is a voice assistant platform that enables businesses to automate phone interactions for:

  • Appointment booking and scheduling
  • Order taking and processing
  • Interview screening and candidate evaluation
  • General customer inquiries

The Service integrates with third-party platforms including Google Calendar, payment processors, and telecommunications providers to deliver its functionality.

3. Account Registration

3.1 Account Creation

To use Vozio, you must:

  • Provide accurate and complete registration information
  • Be at least 18 years of age
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to:

  • Keep your login credentials confidential
  • Use strong passwords
  • Accept responsibility for all activities under your account
  • Notify us immediately of any security breaches

4. Subscription Plans and Billing

4.1 Subscription Tiers

Vozio offers various subscription plans with different features and usage limits. Current plans include:

  • Starter Plan: For small businesses getting started with voice automation
  • Pro Plan: For growing businesses with higher call volumes
  • Enterprise: Custom solutions for large organizations

4.2 Billing Terms

  • Subscriptions are billed monthly in advance
  • All payments are processed securely through Stripe
  • Prices are subject to change with 30 days notice
  • Usage beyond plan limits may incur additional charges
  • No refunds for partial months of service

4.3 Free Trial

New users may be eligible for a free trial period. Trial limitations apply. Your payment method will be charged automatically when the trial ends unless you cancel before the trial period expires.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. You will continue to have access to the Service until the end of your paid period.

5. Acceptable Use

5.1 Permitted Uses

You may use Vozio for legitimate business purposes in compliance with all applicable laws and regulations.

5.2 Prohibited Uses

You may NOT use Vozio to:

  • Violate any laws or regulations
  • Make unsolicited marketing calls (spam/robocalls)
  • Harass, threaten, or abuse others
  • Impersonate any person or entity
  • Distribute malware or engage in phishing
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to systems
  • Use the Service for illegal activities
  • Violate telephone consumer protection laws (TCPA, etc.)
  • Record calls without proper consent where required by law

5.3 Compliance Requirements

You must:

  • Comply with all applicable telecommunications regulations
  • Obtain necessary consents for call recording where required
  • Maintain do-not-call list compliance
  • Use the Service in accordance with local privacy laws

6. Intellectual Property

6.1 Our Rights

The Service and its original content, features, and functionality are owned by Vozio and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain ownership of any content you provide to the Service (voice bot scripts, business information, etc.). By using the Service, you grant us a license to use, store, and process this content solely to provide the Service to you.

6.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service become our property, and we may use them without restriction or compensation.

7. Third-Party Integrations

7.1 Google Calendar Integration

When you connect your Google Calendar:

  • You authorize Vozio to access your calendar in real-time
  • You grant permission to create, modify, and delete calendar events on your behalf
  • You acknowledge that we do not store your calendar data
  • You can revoke access at any time through your Google Account settings

7.2 Other Third-Party Services

The Service integrates with various third-party providers (Twilio, Telnyx, Stripe, etc.). Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party providers.

8. Service Availability and Support

8.1 Uptime

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Service. Scheduled maintenance will be announced in advance when possible.

8.2 Support

Customer support is provided via email. Response times vary by subscription plan. Support hours and contact information are available in your account dashboard.

8.3 Service Modifications

We reserve the right to modify or discontinue the Service (or any part thereof) at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Key points include:

  • We do not store Google Calendar data
  • Call transcriptions are retained for 90 days unless deleted earlier
  • You can export or delete your data at any time
  • All data is encrypted in transit and at rest

10. Disclaimers and Limitation of Liability

10.1 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Voice transcriptions will be 100% accurate
  • AI responses will always be appropriate or correct
  • The Service will meet your specific requirements

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOZIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

11. Indemnification

You agree to indemnify and hold Vozio harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Content you provide or calls you make through the Service

12. Termination

12.1 Termination by You

You may terminate your account at any time by canceling your subscription through the account settings or contacting support.

12.2 Termination by Us

We may suspend or terminate your account immediately, without notice, for:

  • Violation of these Terms
  • Illegal activities
  • Fraudulent or abusive behavior
  • Non-payment of fees
  • Extended inactivity

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • Your data will be deleted according to our data retention policy
  • You remain responsible for any outstanding fees
  • Provisions of these Terms that should survive termination will continue to apply

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and Spain, without regard to conflict of law provisions.

13.2 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

14. General Provisions

14.1 Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

14.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vozio regarding the Service.

14.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

14.4 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.5 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
